Terms of Service

The agreement between you and CustodyBinder.

1. Acceptance of Terms

By accessing or using CustodyBinder ("the Service"), operated by Unmasked Logic, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

CustodyBinder is a private documentation platform for parents involved in custody proceedings. It helps you record journal entries, document incidents and exchanges, attach evidence files, and generate organized reports for use with your legal team.

CustodyBinder is not a law firm and does not provide legal advice. Nothing in the Service - including AI-generated summaries, tags, analysis, or reports - constitutes legal advice, and nothing produced by the Service should be submitted to any court without first being reviewed by a licensed attorney. CustodyBinder is an organizational tool. It does not replace competent legal counsel. Consult a licensed family law attorney in your jurisdiction for all legal guidance.

You are solely responsible for how you use this Service, how you use any outputs it generates, and the accuracy and lawfulness of the information you enter. CustodyBinder does not verify, validate, or vouch for any content you create.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@custodybinder.com if you suspect unauthorized access.

5. Acceptable Use

You agree not to:

  • Upload content you do not have the right to record or possess
  • Upload or create records that violate recording consent laws in your jurisdiction - you are solely responsible for complying with applicable wiretapping and recording laws in your state
  • Upload child sexual abuse material (CSAM) - violations will be reported to the National Center for Missing & Exploited Children and law enforcement
  • Upload malware or content designed to harm our systems or other users
  • Use the Service to harass, stalk, or intimidate any person
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Scrape, copy, or redistribute content from the Service without permission
  • Use automated tools or scripts to access the Service beyond normal use
  • Use the Service in any way that violates applicable law

6. Your Content

You retain ownership of all journal entries, records, and files you create or upload ("Your Content"). By using the Service, you grant us a limited license to store, process, and transmit Your Content solely to operate the Service for you - including processing through AI models where you use AI-powered features.

You represent that you have the right to upload Your Content and that doing so does not violate any law or third-party rights.

Immutability: Evidence records in CustodyBinder are immutable by design. Edits create new versions; original records are never overwritten. This is a feature intended to preserve the integrity of your documentation.

7. AI-Generated Content

CustodyBinder uses AI services for features including transcription, document parsing, suggested tags, and report generation. You acknowledge and agree that:

  • AI outputs may contain errors. Transcriptions, summaries, tags, and analyses may be inaccurate. Review all AI-generated content before relying on it.
  • AI outputs are not legal advice and are not court-ready. Do not present AI-generated summaries, analysis, or any reports generated by the Service to a court without first reviewing them with your attorney. Nothing produced by the Service is intended for direct submission to any court.
  • We do not use Your Content to train AI models. See our Privacy Policy for details.
  • No guarantee of outcomes. We make no representation that use of the Service will affect the outcome of any legal proceeding.

8. Pricing and Payment

Pricing for paid plans is as displayed on the Pricing page. All prices are in US dollars. Prices are subject to change with 30 days' notice to active subscribers. Subscription billing is handled by Stripe. By subscribing to a paid plan, you authorize recurring charges at the applicable billing interval.

9. Cancellation and Refund Policy

All sales are final. We do not offer refunds for subscription payments.

When you cancel a paid subscription, your paid features remain active until the end of your current billing period. At the end of that period your account will be downgraded to the free tier. No partial refunds are issued for unused time. You may cancel at any time from your account settings or by contacting us.

We reserve the right to issue refunds at our sole discretion in exceptional circumstances.

10. Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive or fraudulent behavior, or for any other reason at our discretion. You may delete your account at any time from your account settings.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, and accuracy. We do not warrant that the Service will be uninterrupted or error-free, that AI-generated content will be accurate or suitable for any purpose, or that use of the Service will affect any legal proceeding or outcome.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNMASKED LOGIC LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES arising from your use of the Service, including damages related to court proceedings or legal outcomes, inaccurate AI-generated content, loss of data, or Service interruptions.

Our total aggregate liability to you for all claims arising from or relating to the Service shall not exceed the lesser of (a) the amount you paid us in the 3 months preceding the claim, or (b) $50 USD.

13. Indemnification

You agree to indemnify, defend, and hold harmless Unmasked Logic, LLC and its officers, directors, employees, and agents from any and all claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorney fees and court costs) arising from or related to:

  • Your use or misuse of the Service;
  • Any content you create, upload, or transmit through the Service;
  • Your violation of these Terms or any applicable law;
  • Your violation of any third-party rights, including recording consent laws;
  • Any legal proceeding in which records or outputs from the Service are used;
  • Any reliance you place on AI-generated outputs, reports, or summaries produced by the Service.

You are solely responsible for the content you create and the actions you take using the Service. We do not review your documentation for accuracy, legality, or appropriateness. What you record, and how you use it, is your responsibility entirely.

Attorney fees. If you bring any legal claim or proceeding against Unmasked Logic, LLC arising from or relating to the Service or these Terms, and we substantially prevail in that proceeding, you agree to pay our reasonable attorney fees and costs incurred in defending that claim.

14. Governing Law and Dispute Resolution

Governing Law. These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law provisions.

Jurisdiction. You consent to the exclusive jurisdiction of the state and federal courts in Multnomah County, Oregon for disputes not subject to arbitration.

Arbitration. Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in Portland, Oregon.

Class Action Waiver. Disputes will be resolved only on an individual basis. You waive any right to participate in a class action.

15. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated by email (if you have an account) or by notice on the website at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
